Terms and conditions of sale

Introduction

These general terms and conditions of sale (hereinafter referred to, for brevity, as the “terms of sale”) govern the sale of products marketed by Caseificio Agricolo del Milanello Terre di Canossa soc. coop. agr. (hereinafter referred to, for brevity, as the “seller”) through the website www.caseificiomilanello.it.

All purchase contracts concluded between the seller and the Customer through the website www.caseificiomilanello.it, according to the procedures indicated therein, shall be governed by these terms of sale.

All published prices are inclusive of VAT.

Acceptance of the terms of sale

1. The terms of sale have been prepared in full compliance with the fundamental principles set forth by Directive 97/7/EC and Legislative Decree No. 206/05 (Articles 50 to 68) for the protection of consumers in distance contracts.
These terms of sale shall become effective from the date of acceptance by the Customer on the website, which shall be considered as acceptance pursuant to Article 1341 of the Italian Civil Code. The seller reserves the right to modify these terms of sale at any time by posting the updated version on the website.
Any contractual or non-contractual liability of the seller for direct or indirect damages to persons and/or property caused by the partial or total non-acceptance of an order is excluded.

2. By placing an order through the various methods provided, the Customer declares that they have read all the information provided during the purchasing process and fully accept the terms of sale and payment set forth below.

3. If the Customer is a final consumer (i.e., a natural person purchasing goods for purposes unrelated to their professional activity), upon completion of the online purchasing procedure, they shall print and/or save an electronic copy and, in any case, keep these terms of sale, in compliance with the provisions of Articles 50 to 60 of Legislative Decree 206/2005 on distance sales.

4. Any right of the Customer to compensation and/or indemnity, as well as any contractual and non-contractual liability for direct and/or indirect damages to persons or property caused by the partial or total non-acceptance of an order, is excluded.

Purchase methods

1. The Customer may purchase only the products listed in the Seller’s electronic catalog, as described in the corresponding product information sheets.
Please note that the images accompanying a product description may not be perfectly representative of its features and may differ in color, size, components, or accessories shown.
All supporting information provided is to be considered as general informational material and not necessarily indicative of the actual characteristics of each individual product.

2. All prices listed on the website are retail prices and therefore include VAT.
The Seller reserves the right to change prices at any time without prior notice.

3. The availability of products at the time of order is displayed on the website www.caseificiomilanello.it.
However, due to simultaneous access by multiple users and the possibility of multiple online orders occurring at the same time, product availability may change.
Therefore, the Seller does not guarantee the availability of the items ordered.

Payment methods

Bank transfer in advance

In the case of payment by advance bank transfer, the order will be processed and shipped only after the payment has been credited to the Seller’s bank account.
The payment must be received within 3 business days from the date of order confirmation.

The payment reference (reason for payment) must include the order number and the Customer’s last name.

PayPal or debit/credit card

Payment can be made using a credit card processed through a PayPal account, or directly via PayPal.

Cash on delivery is also available.

Delivery methods

For every order placed on www.caseificiomilanello.it, the Seller will issue an invoice or receipt for the shipped goods.
The information provided by the Customer at the time of order will be considered valid for the issuance of the invoice.

No changes to the invoice will be allowed after it has been issued.

Shipping costs are the responsibility of the Customer and are clearly indicated at the time the order is placed.
Payment for the goods by the Customer will be made using the payment method selected at the time of ordering.

The goods are shipped in cardboard boxes, properly sealed.

The delivery times for the ordered goods are purely indicative and may be subject to change due to force majeure, traffic conditions, general road accessibility, or directives from authorities.
Unless otherwise agreed in writing between the parties, standard delivery will take place during the following hours: from 9:00 AM to 1:00 PM and from 2:00 PM to 6:00 PM, Monday to Friday, excluding public holidays. The Seller shall not be held liable for any delay in processing the order and/or delivering the ordered goods.

At the time of delivery by the courier, the Customer is required to check:

  • that the number of packages delivered matches the number indicated;
  • that the packaging is intact, undamaged, not wet, and/or otherwise altered.

Any damage to the product and/or packaging, and/or any discrepancies must be immediately reported to the courier by writing “INSPECTION RESERVED” on the courier’s delivery receipt.

Once the courier’s delivery document has been signed, the Customer will no longer be able to raise any claims regarding the external condition of the delivered items.

The packaging must be kept by the Customer in case they wish to exercise their right of withdrawal.

Shipping costs

The prices indicated apply to the entire Italian territory.

The shipping cost is automatically calculated based on the weight of the purchased products.

Right of withdrawal

The right of withdrawal allows the Customer to withdraw from a distance purchase contract for any reason and without penalty (subject to the conditions outlined below).

The right of withdrawal consists of a full refund of the amount paid by the Customer upon return of the purchased goods.
By law, it applies to distance purchases made by consumers “for purposes not related to any professional activity carried out,” therefore excluding purchases made by resellers and business Customers in general.

The right of withdrawal is subject to the following conditions:

  • it applies to the product purchased in its entirety; withdrawal cannot be exercised on only part of the purchased product;
  • it does not apply to products once they have been opened;
  • the purchased item must be intact and returned in its original packaging, complete with all parts.
    To minimize damage to the original packaging, it is recommended, whenever possible, to place it inside a second box;
  • by law (Art. 67), the shipping costs for returning the goods to the Seller are the responsibility of the Customer;
  • the shipment, until confirmation of receipt at the Seller’s warehouse, is the sole responsibility of the Customer;
  • in the event that the goods are damaged during transport, the Seller will notify the Customer of the incident within 5 business days of receiving the goods at the Seller’s warehouse. This will allow the Customer to promptly file a claim with the chosen courier and seek reimbursement for the value of the goods (if insured).
    In such cases, the product will be made available to the Customer for return, thereby canceling the withdrawal request;
  • the Seller shall not be held liable for any damage, theft, or loss of goods returned via uninsured shipments;
  • upon arrival at the warehouse, the product will be inspected to assess any damage and/or tampering not related to transportation.

Procedure for exercising the right of withdrawal

To exercise this right, the Customer must submit a withdrawal request to the Seller, including the bank details necessary for the possible refund of amounts paid.
The Seller will send the Customer a paper form via email, which must be printed and sent by registered mail with return receipt within 10 business days from the date of receipt of the goods to:

Upon receipt of the registered letter, the Seller will email the Customer a withdrawal authorization form with a reference number.
This form must be attached to the outside of the package containing the product.
The package must then be sent back to the Seller within 10 business days from the date of authorization.

The Seller will refund the full amount paid by the Customer as soon as possible, and in any case within 30 days from the date of receipt of the withdrawal notice, upon receipt of the returned goods.
The refund will be processed either by reversing the amount charged to the credit card or via bank transfer.

In the latter case, it is the Customer’s responsibility to promptly provide the bank details for the refund, including the account holder’s name, IBAN, and SWIFT codes.

The right of withdrawal is entirely forfeited if the essential condition of the product’s integrity (packaging and/or its contents) is not met, in cases where the Seller verifies any of the following conditions:

  • the absence of the original external packaging and/or internal wrapping;
  • the absence of integral components of the product and/or any defects in the product itself;
  • damage to the product caused by reasons other than transportation;
  • a condition of dirtiness on the product that has compromised its integrity;
  • the product being opened.

The costs and risks of transport for the return are entirely borne by the Customer, who must ship the product exclusively via courier.

Returns of products that are not intact, are damaged, and/or missing accessories and/or original components will not be accepted by the Seller.
Such goods will be returned to the sender at the Customer’s expense, including shipping and any other related costs.

Privacy

Personal Data Protection Code and subsequent amendments and additions

The personal data requested are collected by the Seller and processed, on paper and/or electronic media, in order to fulfill the obligations arising from the contract concluded with the Customer.

The Seller guarantees its Customers compliance with the regulations on the processing of personal data, governed by the Privacy Code set forth in Legislative Decree No. 196 of June 30, 2003, as amended and supplemented.

The Data Controller and Data Processor is Caseificio Agricolo del Milanello Terre di Canossa soc. coop. agr., located at Via Milanello No. 1, 42040 Campegine (RE), Tax Code / VAT Number 00133180356.

The Customer has the right to withdraw consent to the processing of personal data at any time by sending a written communication to the Seller’s registered office.

The Customer also has the right to have their data updated, supplemented, and corrected if inaccurate or incomplete, as well as the right to request the deletion or blocking of data if processed in violation of the law.

These rights may be exercised by the Customer directly with the Seller, who is the Data Controller and Processor, by submitting any requests to Caseificio Agricolo del Milanello Terre di Canossa soc. coop. agr., located at Via Milanello No. 1, 42040 Campegine (RE).

Marketing communications will only be sent with the explicit consent of the Customer, given together with the authorization for processing and sending in the online registration form.

Complaints

Any complaints must be addressed by registered letter with return receipt to Caseificio Agricolo del Milanello Terre di Canossa soc. coop. agr., located at Via Milanello No. 1, 42040 Campegine (RE).

Jurisdiction and applicable Law

The sales contract between the Customer and the Seller is deemed concluded in Italy and governed by Italian law.
For the resolution of civil and/or criminal disputes arising from the conclusion of this sales contract, the exclusive jurisdiction lies with the Court of Reggio Emilia (RE).

Terms and Conditions

The terms contained in this document may be amended by the Seller at any time without prior notice and will be effective from the date of publication on the website www.milanello.it.
